Silva, et al v. Getronics Class Action
We think you should know that the court on its own motion, again continued the hearing of the motion for final approval. It is now scheduled to be heard on March 8, 2010 at 8:30 a.m. The court has asked for additional information (as it did after we filed the motion for preliminary approval, which was granted after we amended that motion), and we fully expect that the court will approve our motion at that time.
Update: 2/20/2010
As many of you know, we were expecting to have our motion for final approval heard the week of February 15th, 2010.
The court has continued the hearing until next month.
While this does not occur that often, every once in a while, for its own reasons, the court simply puts matters over for a while, typically 3-4 weeks, as it has here.
We will let you know, via this website, what happens, when the motion is heard.

On September 21, 2009, both sides appeared in court before the Honorable Gregory Alarcon, Judge of the Los Angeles County Superior Court, for a hearing in the case of Peter Silva, Gustavo Guzman, Paul Lass, Jr., Jeff S. McGill, Thomas R. Mundy and Stanley G. Settle v. Getronics, NV, etc., case no BC368049. At that hearing, the court granted preliminary approval of our settlement of that case.
If you are unsure whether you are a class member, and believe that to be the case, we recommend you contact your former employer to ask about your status if you wish to pursue a claim. If you intend to do that, it may assist you to have ready your dates of employment, your employee number, the location(s) of your employment, and the names of your fellow employees who you believe to already be part of the case when you make such a call.
We also advise that you recommend that your fellow employees, who may have worked for Getronics during the previous six years, inquire as to whether they may be part of this case. Because of the fact of mergers, relocations, changes of address, and so on, it can only assist you and your fellow employees to try to protect your rights in regard to this class action.
Please note: plaintiff’s counsel DO NOT have the names and addresses of the class members. Therefore your assistance in contacting those people, and having them contact us and/or the claims administrator, might go a long way to helping out someone with whom you have worked or are currently working.
